TERMS OF SERVICE

By requesting a commission and submitting payment, the Client ("the Client") agrees to these Terms of Service ("Agreement") established by JeffHarrison02 ("the Artist").
Both the Artist and the Client agree to communicate openly, treat each other with respect, and act in good faith throughout the commission process.
The Client is encouraged to read this Agreement carefully before placing a commission request. The Artist is not responsible for any misunderstandings resulting from the Client's failure to read or understand these Terms.

GENERAL INFORMATION

● The Artist reserves the right to decline or cancel any commission without providing a reason.
● The Client acknowledges and accepts the Artist's style as presented in the Artist's portfolio. Requests to imitate another artist's style will not be accepted.
● The Artist's style may naturally evolve over time, including changes in linework, technique, rendering, or composition. The Client acknowledges and accepts these artistic developments when requesting a commission.
● Color palettes may be adjusted to fit the Artist's style. If exact color accuracy is required, it must be clearly specified in the commission request.
● All commissions are digital artwork only. Physical artwork and printed copies are not offered.
● Every completed illustration will include the Artist's signature, which may not be removed, altered, or obscured.
● Commission prices may vary depending on the complexity and level of detail requested.
● Discounts are not offered. Please do not request price reductions, as doing so is considered disrespectful to the value of the Artist's work.

PERMITTED & RESTRICTED CONTENT

PERMITTED:

● Original Characters (OCs). (Please refer to the Artist's portfolio for examples.)
● Fan Art.
● Mild gore (blood, scratches, simple weapons, etc.).
● LGBT+ themes.
● Mild erotic content. Please inquire before placing a commission request.
● Nekomimi and stylized animal features (such as ears, tails, wings, etc.).

RESTRICTED:

● Highly complex mecha, machinery, or mechanical devices.
● Furry or anthro characters.
● Political, religious, or otherwise controversial themes.
● Realism.
● Western comic or cartoon styles.

For subjects not listed here, the Client must confirm with the Artist before submitting the request.

COMMISSION PROCESS

SKETCH PHASE:

● Work on the commission will begin once the Artist has received the agreed-upon payment from the Client.
● The Artist will send the sketch to the Client for review.
● The Client may request up to two major changes (composition, outfit, background, etc.).

RENDERING PHASE:

● The Artist will send a preview before completing the rendering for the Client's review.
● At this stage, only minor adjustments (such as colors or omitted details) are allowed.
● Major changes, or changes that require significant parts of the artwork to be redrawn, will not be accepted, as these adjustments are only made during the Sketch Phase.

COMMUNICATION & UPDATES:

● The Client may request updates in moderation throughout the commission process. Excessive requests may affect the delivery time or result in the cancellation of the commission.
● The Artist may request clarification, references, or additional information whenever necessary.
● The Client has five (5) business days to respond to any requested information.
● If the Client's lack of response causes delays to a previously agreed delivery date, the Client must allow an extension of the deadline. This shall not constitute grounds for cancellation.

FINAL DELIVERY:

● Delivery will only take place after full payment has been received.
● The Client will receive:
➜ A high-resolution version with a watermark (Personal Use).
➜ A low-resolution version with a watermark (Social Media Use).
● Final files will be delivered via email or another previously agreed platform in PNG, JPG, GIF, or another equivalent format.
● The Client is responsible for keeping a copy of all delivered files. The Artist is not responsible for any loss of those files after delivery.
● Editable files (PSD, CLIP, etc.) are not included by default and must be requested in advance for an additional fee.

DELIVERY TIME

● Delivery times begin once the agreed-upon payment has been received.
● A single illustration has an estimated completion time of 1 to 2 business weeks. Multiple commissions or more complex artworks may require 4 to 6 business weeks.
● Commissions are completed in the order they are received through a waiting list, which may be available for the Client to view if published.
● If the Client requires delivery by a specific date, this must be stated when requesting the commission. In such cases, an additional priority fee will apply.
● The delivery time may be extended due to various factors, including previous commissions, artwork complexity, multiple revisions, the Client's response time, or circumstances beyond the Artist's control.
● The Artist prioritizes the quality of the artwork over speed and will make every reasonable effort to complete each commission within a reasonable timeframe.
● Any significant delays will be communicated to the Client as early as possible.

PAYMENTS

GENERAL INFORMATION:

● Work on the commission will only begin once the agreed-upon payment has been received and confirmed.
● Do not submit any payment until the Artist has confirmed and accepted the commission. Payments made before acceptance or without the Artist's request are non-refundable.

AVAILABLE PAYMENT METHODS:

● Wise (USD) for international Clients.
● Clients located in Argentina may pay by bank transfer or bank deposit, subject to prior agreement with the Artist.

PAYMENT STRUCTURE & DEADLINES:

● A 50% upfront payment is required before work begins. The remaining 50% must be paid once the illustration is completed.
● The first payment must be made within 24 hours after the commission has been confirmed. Otherwise, the commission may be rescheduled or canceled.
● If the Client requires a payment plan, it must be discussed and agreed upon with the Artist before the commission begins.

CLIENT RESPONSIBILITIES:

● The Client is responsible for verifying all payment information before making any transfer.
● If a payment is sent to the wrong account or using incorrect payment details, the Artist will not begin work or deliver the artwork until the funds have been successfully received in the correct account.
● Any actions required to recover funds sent by mistake are the sole responsibility of the Client.

USAGE POLICY

RIGHTS OF THE ARTIST AND THE CLIENT:

● The Artist retains all copyright and intellectual property rights to the commissioned artwork.
● The Client retains ownership of their original characters but may not claim authorship or ownership of the commissioned illustration.
● The Artist may use the commissioned artwork for promotional and commercial purposes (including WIPs, portfolio, prints, archives, etc.), unless a confidentiality agreement has been made.

CONFIDENTIALITY:

● If the Client wishes the commissioned artwork to remain unpublished by the Artist, this must be requested when placing the commission. This option is subject to an additional confidentiality fee.
● If the Client later decides to allow the Artist to publish the artwork, the Artist must be notified. The confidentiality fee is non-refundable.

USAGE RESTRICTIONS & PROHIBITIONS:

● Sketches, WIPs, and any non-final files may not be published, edited, or used by the Client.
● It is strictly prohibited to modify, edit, trace, resell, or use the commissioned artwork for purposes other than those agreed upon. This strictly includes, but is not limited to, the use of the artwork for training artificial intelligence, creating automated derivatives, or incorporating it into blockchain-based systems, NFTs, or similar present or future technologies.
● Failure to declare the intended use of the artwork, misuse of the granted license, or failure to notify the Artist of any change in usage will be considered serious violations of these Terms. Such violations may result in the cancellation of the commission without refund, the revocation of any active licenses, or the Artist refusing to accept future commissions from the Client.

THIRD-PARTY COPYRIGHTS:

● If the commission includes characters, trademarks, or other intellectual property belonging to third parties (Fan Art), the Client declares that the commissioned artwork will be used for personal and non-commercial purposes only, unless the Client holds the appropriate legal authorization for commercial use.
● The Client assumes full responsibility for how the commissioned artwork is used. The Artist shall not be held responsible for any claims resulting from the unauthorized use of copyrighted material or registered trademarks.
● If the Client requests commercial use of characters or intellectual property they do not own, the Client must provide authorization from the copyright holder. Without such authorization, commercial use is strictly prohibited.

PERSONAL COMMISSIONS

● By default, all commissioned artwork is licensed for Personal Use only.
● Any reproduction, distribution, or commercial use is strictly prohibited unless a Commercial License has been agreed upon and purchased.
● The Client may share the commissioned artwork on social media or non-profit websites (such as avatars, banners, or decorative images), provided that proper credit is given to the Artist.

MONETIZED CONTENT LICENSE:

● The Monetized Content License permits the use of the commissioned artwork in content that generates revenue or direct monetization, including monetized livestreams, ad-supported videos, memberships, revenue-generating channels, or any platform where the artwork contributes to a commercial activity.
● This license does not permit the production or sale of merchandise, nor the mass reproduction of the artwork. A Commercial License is required for those purposes.
● A 100% surcharge will be applied to the base commission price.

COMMERCIAL LICENSE:

● The Commercial License permits the production, reproduction, and sale of merchandise and derivative products (including prints for sale, clothing, stickers, physical or digital products for resale, etc.) without limitation on the number of reproductions or units sold.
● The Commercial License does not transfer copyright, grant exclusive rights, or assign ownership of the commissioned artwork or its intellectual property.
● A 200% surcharge will be applied to the base commission price.

GENERAL CONDITIONS FOR ALL LICENSES:

● The Client must clearly declare the intended use of the commission.
● If the Client wishes to expand or change the originally agreed use, the Client must obtain the Artist's explicit approval and pay the corresponding price difference.
● If the Client is unsure which license is required, they must consult the Artist before confirming and paying for the commission.

REFUNDS POLICY

REFUND CALCULATION:

● If the refund is due to the Artist's responsibility, it will be calculated based on 100% of the total amount paid by the Client.
● If the refund is due to the Client's responsibility, it will be calculated based on the net amount received by the Artist, after deducting payment processing fees, taxes, withholdings, and any other applicable charges.

REFUNDS DUE TO THE ARTIST'S RESPONSIBILITY:

● If the Artist cancels the commission for any reason or fails to meet the previously agreed maximum delivery date, the Client will be entitled to a 100% refund.
● If the Client chooses to keep the work completed up to that point, the refund will be reduced to 50%.

REFUNDS REQUESTED BY THE CLIENT:

The Client may request to cancel the commission and receive a refund only in the following situations:
● Before the Artist has started working on the commission.
● Before approving the initial sketch. In this case, the Client will receive a refund equal to 50% of the net amount received by the Artist, in recognition of the work completed up to that point.

NON-REFUNDABLE SITUATIONS:

● Once the inking process has started, no refunds will be granted under any circumstances, regardless of the stage of completion or the reason for the cancellation.

CHARGEBACKS:

● If the Client initiates a chargeback or payment dispute without first attempting to resolve the issue directly with the Artist, the Artist shall not be obligated to continue or restart the commission.

ACCEPTANCE OF THE AGREEMENT

● By requesting a commission, the Client agrees to the Terms of Service in effect on the date the commission request is submitted.
● The Client acknowledges that this Agreement may receive clarifications or procedural updates during the course of the commission. Such updates shall be accepted provided they do not modify any essential terms or previously agreed custom arrangements.
● Any updates to these Terms of Service made after the commission has been completed and delivered shall not apply retroactively and will not affect any prior agreements.
● If the Client does not agree with these Terms of Service, they are advised not to request a commission.

TÉRMINOS Y SERVICIOS

Al solicitar una comisión y realizar un pago, usted ("el Cliente") acepta los presentes Términos de Servicio ("Acuerdo"), establecidos por JeffHarrison02 ("el Artista").
Tanto el Artista como el Cliente aceptan actuar desde la transparencia, el respeto mutuo y la comunicación clara.
Se recomienda leer este Acuerdo detenidamente antes de continuar con el pedido. El Artista no será responsable por interpretaciones erróneas derivadas de no haber leído o comprendido estos términos.

INFORMACIÓN GENERAL

● El Artista podrá rechazar o cancelar un encargo sin necesidad de justificarlo.
● El Cliente acepta el estilo artístico del Artista tal como se presenta en su galería. No se aceptarán solicitudes para ilustrar en estilos ajenos.
● El estilo del Artista puede presentar variaciones con el tiempo (trazo, técnica, composición). El Cliente debe considerar esto al solicitar un encargo.
● Las paletas de color pueden adaptarse al estilo del Artista. Para fidelidad exacta, debe especificarse claramente en el formulario.
● Todas las obras son digitales. No se realizan trabajos o envíos de impresiones físicas.
● Toda ilustración incluirá la firma del Artista, la cual no puede removerse ni alterarse.
● El precio de la comisión puede variar según el nivel de detalle requerido.
● No se aplican descuentos ni rebajas en los encargos, solicitarlos se considera inapropiado hacia el trabajo del Artista.

CONTENIDO PERMITIDO Y RESTRINGIDO

PERMITIDO:

● Personajes originales. (Ver galería del Artista por ejemplos).
● Fanart.
● Gore sutil (sangre, rasguños, armas simples).
● Temáticas LGBT+.
● Contenido erótico sutil. (Preguntar primero).
● Nekonomimi o características animales estilizadas (orejas, cola, alas, etc.).

RESTRINGIDO:

● Mecha, máquinas o dispositivos altamente complejos.
● Personajes tipo Furry / Anthro.
● Temas políticos, religiosos o de carácter polémico.
● Realismo.
● Estilo cómic o cartoon occidental (estética americana).

Para temas no especificados en esta lista, el Cliente debe consultar previamente al Artista antes de realizar el pedido.

PROCESO DE ENCARGO

BOCETO:

● El trabajo de la comisión comenzará una vez que el Artista reciba el pago acordado con el Cliente.
● El Artista enviará el boceto para la revisión del Cliente.
● El Cliente podrá solicitar hasta dos cambios importantes (composición, vestuario, fondo, etc).

RENDERIZADO:

● El Artista enviará una vista previa antes de finalizar el renderizado para revisión del Cliente.
● En esta etapa solo se permiten ajustes menores (color, detalles omitidos).
● No se aceptan cambios mayores o que impliquen redibujar partes significativas, ya que estos ajustes solo se realizan en la etapa de boceto.

COMUNICACIÓN Y ACTUALIZACIONES:

● El Cliente podrá solicitar actualizaciones con moderación durante el proceso. Las solicitudes excesivas podrán afectar los plazos o derivar en la cancelación del encargo.
● El Artista podrá solicitar aclaraciones, referencias o información adicional cuando sea necesario.
● El Cliente dispone de 5 días hábiles para responder a la información solicitada.
● Si la falta de respuesta del Cliente provoca retrasos respecto a una fecha límite previamente establecida, deberá conceder una extensión del plazo de entrega, sin que ello constituya motivo de cancelación.

ENTREGA FINAL:

● La entrega se realizará únicamente luego de recibir el pago total.
● El Cliente recibirá:
➜ Una versión en alta resolución con marca de agua (Uso Personal).
➜ Una versión en baja resolución con marca de agua (Uso en Redes Sociales).
● Los archivos finales serán enviados por correo electrónico o por la plataforma acordada en formato PNG, JPG, GIF u otro equivalente.
● El Cliente es responsable de resguardar una copia de todo lo recibido. El Artista no se hace responsable por la pérdida de los mismos.
● Los archivos editables (PSD, CLIP, etc.) no están incluidos por defecto y deberán solicitarse por anticipado, con un costo adicional.

PLAZOS DE ENTREGA

● Los plazos de entrega comienzan a contar una vez acreditado el pago acordado.
● Una ilustración individual tiene un tiempo estimado de 1 a 2 semanas hábiles. Los encargos múltiples u obras complejas pueden requerir entre 4 y 6 semanas.
● Los encargos se gestionan por orden de llegada mediante una lista de espera, la cual podrá consultarse si se encuentra publicada.
● Si el Cliente requiere una entrega para fecha específica, deberá indicarlo al solicitar el encargo. En estos casos se aplicará una tarifa adicional por prioridad.
● El plazo puede extenderse por diversos factores: encargos previos, complejidad de la obra, múltiples correcciones, rapidez de respuesta del Cliente, o situaciones de fuerza mayor.
● El Artista prioriza la calidad del trabajo sobre la rapidez, procurando completar cada comisión en un tiempo razonable.
● Cualquier retraso significativo será comunicado al Cliente con la mayor anticipación posible.

PAGOS

INFORMACIÓN GENERAL:

● El encargo comenzará únicamente una vez que el pago acordado haya sido acreditado y confirmado.
● No realice pagos antes de que el Artista confirme y acepte la comisión. Los pagos no solicitados o realizados antes de la aceptación no serán reembolsados.

MÉTODOS DE PAGO DISPONIBLES:

● Wise en dólares estadounidenses (USD) para clientes internacionales.
● Clientes de Argentina podrán pagar mediante transferencia bancaria o depósito, previamente acordado con el Artista.

ESTRUCTURA Y PLAZOS DE PAGO:

● Se requiere un anticipo del 50% para iniciar el trabajo. El 50% restante se abonará al finalizar la ilustración.
● El primer pago debe realizarse dentro de las 24 horas tras la confirmación; de no efectuarse, el encargo podrá ser reprogramado o cancelado.
● Si el Cliente requiere un plan de pago, deberá acordarlo con el Artista antes de iniciar la comisión.

RESPONSABILIDADES DEL CLIENTE:

● El Cliente es responsable de verificar correctamente los datos de pago antes de realizar cualquier transferencia. Si el pago se envía a una cuenta incorrecta o con datos erróneos, el Artista no podrá iniciar el trabajo o entregar la obra hasta que el monto sea efectivamente acreditado en la cuenta correspondiente. Cualquier gestión para recuperar fondos enviados por error será exclusiva responsabilidad del Cliente.

POLÍTICA DE USO

DERECHOS DEL ARTISTA Y DEL CLIENTE:

● El Artista conserva todos los derechos de autor y propiedad intelectual de la obra.
● El Cliente conserva los derechos de sus personajes originales, pero no podrá reclamar autoría ni propiedad sobre la ilustración realizada.
● El Artista puede utilizar la ilustración con fines promocionales y comerciales (WIPs, portafolio, impresiones, archivos, etc.), salvo que exista un acuerdo de confidencialidad.

TÉRMINOS DE CONFIDENCIALIDAD:

● Si el Cliente desea que la obra no sea publicada por el Artista, deberá solicitarlo al momento de realizar el pedido. Esta opción implica una tarifa adicional.
● Si el Cliente decide más adelante permitir su publicación, deberá notificarlo. Dicha tarifa por privacidad no será reembolsada.

RESTRICCIONES DE USO Y PROHIBICIONES:

● Los bocetos, WIPs o archivos no finales no podrán ser publicados, editados ni utilizados por el Cliente.
● Está estrictamente prohibido modificar, editar, trazar, revender o utilizar la obra para fines no acordados. Esto incluye, de manera estricta, su uso para entrenar inteligencia artificial, generar derivados automatizados o integrarla en sistemas basados en blockchain, NFTs o tecnologías similares, presentes o futuras.
● El uso no declarado, el empleo indebido de la licencia o la omisión de informar un cambio de la misma se considerarán infracciones graves a estos Términos. Dichas conductas podrán derivar en la cancelación del trabajo sin reembolso, la revocación de licencias vigentes o la negativa del Artista a aceptar futuros encargos del Cliente.

COPYRIGHT DE TERCEROS:

● Cuando la comisión incluya personajes, marcas o elementos pertenecientes a terceros (Fanart), el Cliente declara que la ilustración será utilizada únicamente con fines personales y no comerciales, salvo que cuente con una licencia legal para su explotación.
● El Cliente asume toda responsabilidad por el uso que dé a la obra. El Artista no será responsable por reclamos derivados del uso no autorizado de material protegido por derechos de autor o marcas registradas.
● En caso de que el Cliente solicite un uso comercial de personajes o propiedades intelectuales que no le pertenecen, deberá presentar la autorización correspondiente del titular de los derechos. Sin dicha autorización, el uso comercial está estrictamente prohibido.

COMISIÓN PERSONAL:

● Por defecto, la obra es solo para uso personal.
● Cualquier reproducción, distribución o uso comercial está estrictamente prohibido a menos que se haya acordado y pagado una tarifa comercial.
● El Cliente puede compartir la obra en redes sociales o en sitios web sin fines de lucro (avatar, banner o decoración) siempre que acredite correctamente al Artista.

CONTENIDO MONETIZABLE:

● La licencia de Contenido Monetizable autoriza el uso de la ilustración en contenidos que generen ingresos o monetización directa, tales como streams monetizados, vídeos con anuncios, membresías, uso en canales con ingresos, o cualquier plataforma donde la obra contribuya a una actividad económica.
● Esta licencia no autoriza la producción o venta de mercancía ni la reproducción masiva de la obra. Para esto último se requiere la licencia comercial.
● Aplicará un recargo del 100% sobre la tarifa base de la comisión.

CONTENIDO PARA COMERCIALIZAR:

● La licencia de Contenido para Comercializar autoriza la producción, reproducción y venta de mercancía y productos derivados (prints para venta, ropa, stickers, artículos físicos o digitales para reventa, etc.), sin límite en el volumen de reproducciones o unidades comercializadas.
● La licencia comercial no implica la cesión de derechos de autor, exclusividad de uso ni transferencia de la propiedad intelectual de la obra.
● Aplicará un recargo del 200% sobre la tarifa base de la comisión.

CONDICIONES COMUNES A TODAS LAS LICENCIAS:

● El Cliente deberá declarar claramente el tipo de uso que necesita para el encargo.
● Si el Cliente desea ampliar o modificar el uso inicialmente acordado deberá solicitar la autorización expresa del Artista y abonar la diferencia de tarifa correspondiente.
● En caso de dudas sobre el tipo de uso, el Cliente deberá consultarlo antes de confirmar y pagar la comisión.

REEMBOLSOS

NOTA SOBRE EL CÁLCULO:

● Si el reembolso es por responsabilidad del Artista, se calculará sobre el 100% del monto abonado por el Cliente.
● Si el reembolso es por responsabilidad del Cliente, se calculará sobre el monto neto recibido por el Artista, descontando comisiones, impuestos, retenciones y demás cargos aplicables.

REEMBOLSOS POR RESPONSABILIDAD DEL ARTISTA:

● Si el Artista cancela el encargo por cualquier motivo o incumple la fecha máxima de entrega previamente acordada, el Cliente tendrá derecho a un reembolso del 100%.
● Si el Cliente opta por conservar el trabajo realizado hasta ese momento, el reembolso se reducirá al 50%.

REEMBOLSOS POR SOLICITUD DEL CLIENTE:

El Cliente podrá solicitar la cancelación del encargo y el correspondiente reembolso únicamente en las siguientes situaciones:
● Antes de que el Artista haya comenzado a trabajar en la comisión.
● Antes de aprobar el boceto inicial. En este caso, el reembolso corresponderá al 50% del monto neto recibido por el Artista, en reconocimiento al trabajo realizado hasta ese momento.

NO APLICAN REEMBOLSOS:

● Una vez iniciado el proceso de entintado, no se otorgarán reembolsos bajo ninguna circunstancia, independientemente de la etapa de avance de la comisión o del motivo de la cancelación.

CHARGEBACKS:

● Si el Cliente inicia un reclamo de devolución sin intentar resolver el inconveniente directamente con el Artista, este no estará obligado a continuar o reiniciar el encargo.

ACEPTACIÓN DEL ACUERDO

● Al solicitar una comisión, el Cliente acepta los Términos de Servicio vigentes en la fecha que realiza el encargo.
● El Cliente reconoce que este documento puede recibir ajustes aclaratorios o de proceso durante el desarrollo del trabajo, los cuales acepta siempre que no alteren condiciones esenciales o acuerdos personalizados previos.
● Las actualizaciones del TOS realizadas después de la entrega final y del cierre del encargo no se aplicarán de forma retroactiva ni afectarán acuerdos previos.
● Si el Cliente no está de acuerdo con estos Términos de Servicio, se le recomienda no solicitar el encargo.
